We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise. Terms of Sale
Your contract for purchases made through this site is with JS Performance, and you undertake that any and all goods ordered by you are for your own private and domestic use only. Accordingly, JS Performance do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from us. You must be eighteen years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.
While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. We will do our best to correct errors and omissions as quickly as practicable after being notified of them. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. You may cancel your order at any time prior to your order being processed.
You agree that email can be used as a long-distance means of communication. You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it. You undertake that all details you provide to JS Performance for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered. If there are any changes to the details supplied by you it is your responsibility to inform JS Performance as soon as possible.
Delivery and Returns
All deliveries are usually made between 4 and 5 working days from the date the order is received. We will replace or where appropriate repair any goods that fail within 12 calendar months of delivery by reason of faulty materials or workmanship, provided that you notify us within a reasonable period of the failure. In all cases, remedies offered by us shall not affect your statutory rights or our responsibilities under the sale of goods act. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, JS Performance shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question.
If you decide for any reason you no longer want the goods purchased, you can return them within thirty days in their original packaging and unused. We will then give you a full refund, minus the cost of returning the goods to us. Alternatively you can arrange for the goods to be returned yourselves. If you require assistance please contact us. JS Performance reserves the right to make a 15% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. JS Performance also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version. These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website. Nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law. This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England. Under data protection laws, you have the right to request a copy of the personal information we hold about you and to have any inaccuracies corrected.
